1. Agreement to Terms

By accessing or using ECUfy (“the Service”, “we”, “our”), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service.

These terms constitute a legally binding agreement between you and ECUfy, governed by applicable EU law.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts in your jurisdiction to use the Service and make purchases.

3. Digital Products — Nature of Sale

All products sold on ECUfy are digital goods (ECU files, DAMOS definitions, FRF packages, radio codes, software). By completing a purchase you acknowledge:

• The product is a digital file delivered electronically.
• You expressly consent to immediate delivery and waive any applicable right of withdrawal under EU consumer law for digital content that has already been delivered.
• All sales are final. No refunds are issued once a file has been downloaded.

4. Download Limits

Each purchased file may be downloaded up to 5 times within 12 months of purchase. Download limits exist to prevent unauthorised redistribution. If you experience technical difficulties preventing a successful download, contact support before exhausting your attempts.

5. Permitted Use

Purchased files are licensed to you for:

• Personal or professional use on vehicles you own or are authorised to service.
• Research and development purposes in an automotive or technical context.

You may not:

• Resell, redistribute, share, or sublicense any purchased file.
• Upload purchased files to any public or private file-sharing platform.
• Use files in a manner that violates applicable laws or vehicle regulations in your jurisdiction.
• Reverse-engineer, decompile, or modify files for redistribution.

6. Intellectual Property

ECU files and related content are the intellectual property of their respective original equipment manufacturers (OEMs) or software developers. ECUfy facilitates access to these files for professional and technical use. Ownership of the underlying software is not transferred by purchase.

ECUfy's website design, branding, and original content are protected by copyright and may not be reproduced without permission.

7. Payments

All prices are displayed in Euros (EUR) and include applicable taxes unless stated otherwise. Payments are processed securely by Stripe. ECUfy does not store payment card details.

In the event of a failed payment, no file access will be granted. If you believe you were charged incorrectly, contact us within 14 days at support@ecufy.com.

8. Disclaimer of Warranties

Files are provided “as is”. ECUfy does not warrant that files are error-free, suitable for a particular vehicle, or compliant with emissions regulations in your jurisdiction. You are solely responsible for verifying compatibility before use. ECU remapping may affect vehicle warranties, roadworthiness, and legal compliance — consult a qualified technician.

9. Limitation of Liability

To the fullest extent permitted by law, ECUfy shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use our files or services, including but not limited to vehicle damage, ECU damage, loss of data, or regulatory penalties.

Our total liability for any claim shall not exceed the amount paid by you for the specific product giving rise to the claim.

10. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorised access at support@ecufy.com.

11. Termination

We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or attempt to abuse download limits or payment systems. Termination does not entitle you to a refund for prior purchases.

12. Governing Law

These Terms are governed by and construed in accordance with EU law. Any disputes shall be subject to the exclusive jurisdiction of the competent courts.

13. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms. Material changes will be notified via email.
